Most people has very misconception about "parole". It is not a free/flexible travel document like visa. As a AOS applicant, one should not leave US till it is approved/denied. One MUST present in US during AOS. The parole is only for any emergency purpose; which is similar to prisioners. As USCIS is flexible, in approving the AP, the people don't realize the travel limitation of AP. They are travelling on AP for vatation/fun etc.. As per law, the AP is not intended for it. The CBP officer was right in asking the legitimacy of the travel. The AP document clearly says it is based on "humanitation" admission to retrun after an emergency travel.
Technically, you are right. But on the other hand, it was at a time when one had to wait at the most 6 months for AOS.
But, for people from India, on EB categories, the wait is not months, its in YEARS. So, its irrational to go by whats written there.
On the other hand: I think we must request USCIS to recognize this underlying problem with EB folks that are primarily from India. They must print an exception on the AP for India and exclude the wording "for emergency purpose only". I don't know if USCIS has the discretionary power to amend minor changes.

After nearly 15 months, going by recent postings here , I was tempted to call IO to get any update on my 'pending I-485' . I happened to talk to a nice IO on my first attempt. She took some time to check on status and told me my 'name check is pending'. I told her on previous occasions / Infopass I was all the time told 'everything for me, especially name check is cleared'. She came out with an explanation---- your 2nd FP was cleared on 17 July 09 (Yes, I had 2nd FP on 7/6/09 as Ist FP in Sept 07 'expired' after 15 Mo validity) and that is why new 'name check' is initiated.
I can not believe this. If this is so, they may have to wait for 180 days even if there is nothing adverse from fbi and the dates become current.
It is very creepy.....

Well, there are many folks here including me who filed around first week of june.. I haven't heard anyone getting the EAD yet. I haven't seen any lud's after the receipts. Hopefully, one more week to go and then we are all good to get the 2yr EAD....
Same experience. The checks were cashed super quick and the receipt notices were also mailed out. Now we wait in anxiety to see whether we receive the 1 year or the 2 year EADs.

You've got it.
You do not have to copy the USCIS. Be nice and polite. Explain that you applied for EAD more than 90 days ago. Provide your I-765 receipt number.
Ask them to follow procedures in Aytes memo. Show the memo. Ask them to contact NSC where your I-765 is pending and alert them about your situation. (Contact NBC or Service Center to initiate EAD production—either Interim or Non-Interim). Ask them to provide Notice to you acknowledging status inquiry. If IO refuses to do that, ask to talk to the supervisor and repeat the above. It works. Basically, the federal regulations require them either to issue EAD in 90 days or issue interim EAD.

I guess the polling on PD basis is futile it will give people false hope....
Only folks with ND prior to current processing times can expect to have a chance at appoval...I see many people over here beyond the processing date window and are still hoping to get approved....
Let's see if this theory is right or not come september.....if only my lawyer had mentioned that ND over rides PD I'd have forced him to file on July 2nd and not wait till July end....

Your point of ND vs. RD (vs. PD even) is certainly valid, esp. given the randomness of dates that the USCIS follows. However, three things to keep in mind are -
1. Last Aug and Sept ('08), neither ND nor RD theories worked, if you believed all the dates entered under .com. Approvals were quite random - some cases with ND beyond published dates were approved, which led us to believe they were processing in order of RD, but no FIFO was followed based on RD.
2. The dates published recently (09/15/2007 at NSC and 08/30/2007 at TSC) are as of June 30, 2009. It has been nearly two months since and an update is possible. Also, by admission of the USCIS, these dates are not exact, only estimates of what cases are being worked on.
3. Finally, these dates do not serve as guidance for IO to approve cases; they serve as an indication to us applicants as to which cases have been processed thus far. And they help determine if we can file an SR.

As OBAMA is going to have meeting this monday it will clear lots of things for us.
Biggest one is if there will be a CIR or not ? if yes then what is time frame.
if he signals yes for CIR discussion ( I am not saying passing ) then all these bills will be crap. and we should start lobby and advocay. If he doesnot think for CIR for year or two then we can push for this one as we will not have any agenda left. ( Except same and simmilar job )

This is exactly what I thought when one of my son's friend was working very hard on spelling bee and needless to say he reached the topmost level in that event. As a parent I fail to understand why championing the spelling bee is of such a great importance for a child's all-round growth.
This whole spelling bee thing is the stupidest thing I have ever heard of. By any standards, it is pure and simple torture to subject the kids to memorizing thousands of words and their stupid spellings. And what use is that? Have they never heard of something called SPELL-CHECK in Microsoft Word and other email services ?
Or are they afraid that their kid will go to a job interview and someone might ask them to spell the word that no one on the planet ever uses and is only present in the Oxford Dictionary.
Those who subject their kids to such a regimented, rigorous, scripted childhood are preparing a next generation of work-force that would only know how to follow the orders and accept directions.
85 % of the fortune 500 CEOs are not MBAs. And the other 15% that have an MBA, only 3 of the 15 have done MBA from an IVY LEAGUE school.
What that tells you is that too much education and scholarly childhood increases your job security, in that sense that you will never be unemployed, but it decreases the chances that you will be on the top or you will be a billionaire.
The biggest prize goes NOT TO people who can follow directions and know everything, but who can GIVE directions and get things done.

I agree with your suggestion, but for attorney change, do you think any bad effects? Someone told me judge and jury might question why you change attorney? We already move out that place, so no chance to contact them. Also in terms of the law, we can't access witness.

I believe this case is a dismissed case from the beginning. Police/lawyer have nothing else to do, I mean, they are just doing their jobs, and they cant be funny at all. They will go by what the law says. Period. Research what the law says.

Everyone, I mean everyone will have disputes. Now, the dispute is so large that the neighbours call the cops? I will guarantee that every IVian here who is married for 3 years or longer (or already has a kid), has had a bad argument, where either of the spouse has screamed(or spoken with a very high tone).
Your wife continued screaming so loud that you had to cover her mouth to pacify her, bcos she peed on herself.
Wait a minute here, if I was a cop, I would definitely judge this as DV. Unless, you absolutely had shut up to begin with. No chair, no drag, no nothing. which now has to be proved as misinterpretation.
And any offer that your lawyer brings you is trying to resolve the case, You are the one who should decide whether this case goes to trial or not.
Past peeing incidences, where the neighbours heard screams should be kept in mind.
And finally, take English lessons, dude, your written English too is very poor.
You can actually submit this as a proof that you were misinterpreted, if this goes to a Jury trial.
Also, please Delete any proof of the incidence, including the one posted here. No one shold be seeing the 100% truth, your 100% truth is scary.

I have worked with a company on h1b from 1st jul to 12 nov in 2007 on h1b visa. They did not pay me for last 45 working days. My employer is telling about the following clause in in my offer letter:
SALARY: You will be paid an amount equal to a 70% basis of your bill rate based on the understanding that you will work with us for a period of at least one year. If you leave Company before completing 1 year of employment your compensation will be adjusted to a $55,000 per year basis and the excess amount paid to you will be deducted from the last two months of your salary.
Please let me know whether this is legal to have this kinda clause in offer letter. Is there any way to get my salary?
