Hi Gurus,
I am in a unique situation and your valuable advice is highly appreciated. I worked for company A for 3 years and filed my 140 and 485(july 2007). I quit the company in may this year and joined another company. My 140 was approved on 06/16/2006. recently my previous employer revoked my I-140. I got a notice from USCIS that my I-140 and I-485 has been withdrawn. As per my new attorney since i meet all the conditions for job porting (180 days, 140 approved, and same job profile), no one else other than me can withdraw my I-485 application. my attorney filed an MTR today. Can i work while my MTR is pending. Is Withdrawal acknowledgement notice is same as denial notice ? please help

we totally understand your frustration, but we can't achieve anything by showing anger on the forums right? we need to take action, we need to go to DC, because of rally we may get our GC fast. if have already planned to attend rally then thank you. if not make a desicion now, its now or never.
How the hell can all the catagories after EB3 be current yet EB3 be back logged???? By rights they should be unavilable until we are current.

Anybody wont be eligible. Canada has been fine tuning the immigration since 2002.
Now only people who have studied or worked in Canada on work permit are eligible.
family based is greatly restricted unlike US where around 80 is non-skill based.
That may be the unofficial version. Officially you can apply even you haven't worked or studied in Canada if you qualify as a skilled worker with a year of experience. You get extra points for having a job offer from a Canadian employer but not having one does not disqualify you automatically. I'm not talking about getting the GC. I'm just talking about the application process. Some kind of processing is needed even to reject an application and I do not think USCIS is capable of handling the increased traffic that switching to a point based system would result in.

I have been playing safe these many years..... I can't take anymore of Apartment living.... it was OK when kids were 2-3 years old... not anymore..... I guess... you need to be little aggressive.... ;)

Hi John, thanks for bringing this to the attention of our members. Lets hope everybody finds time to call Sen Cornyn to thank him for introducing this bill. Another thing I wanted to say is that, our members are all busy with 485 filing and stuff so we can expect a response only after the 17th of August when the excitement of 485 filing is over. Even though it was defeated it doesn't seem to be a very hated idea by the majority since 5 more votes would have made it safe. So there still seems to be a positive factor lingering around for us the "legal immigrants". Hope we are able to capitalize on it soon. IV is infact becomming stronger and more influential thanks to the dedicated efforts of the leader and the members. Pls keep up the spirit for all of us. We need vigilant people like you to do the work to spot opportunities and failures for the community. Thanks.

Guys,
First of all, please be decent to each other. Now, to the PBEC issue - this is a major problem, and a huge issue for all of us. Currently, the debate in Senate/Congress is centered around Immigration reform and this is a definitely a good time to raise these issues.
There are a few things we should strive for:
1. Keep all provisions of Specter's bill related to EB.
2. Re-instate per country soft limit.
If both of these provisions are passed, Priority dates for all countries will be current in EB2 and will rapidly move in EB3. A lot of folks in PBEC might be able to use PERM to apply another labor and priority dates will loose their importance, so it is important that these provisions pass.
Its easy to say than to do it. Not everybody that have been wait in PBEC have a chance to do Perm. Not every company willing to redo the case.
Senate should address legal immigration first before do the reform for Illegal immigration. They can keep give amnesty to million of illegal immigration, and million will come why ? one quick answer crapy system.
If only they can create a better system (not like PBEC and DBEC) I believe US will have less ilegall immigrant.

One of the least heard, but the most pressing issue that continues to plague day-to-day lives of thousands of high-skilled legal immigrant workers in the US is Retrogression causing deep anxiety, frustration and considerable delay in processing and approving of permanent residency, also called Green Card.
For employment-based green cards, every country has a fixed number of immigrant visas or quota on a per-year basis. When I-485 adjudication or adjustment of status from non-immigrant to immigrant status (example H1-B to Permanent Resident) successfully concludes, it leads to approval of green card. This approval requires a visa number to be available. But, if the visa quota for a country has been used up, visa numbers become unavailable for that country. This unavailability of visa number is the effect of retrogression, wherein, the US Department of State, based on the current demand for the visas decides allocation of how many visa numbers can be released to meet the demand and be in conformance with the pre-set quota.
Employers file for green cards for skilled professionals to obtain a legal immigrant status for future employment. Skilled professionals who have green card processing pending typically wait for their green cards to be approved for an average period of 5 years. During this period, they have very limited, if any, freedom to exercise choice with changing jobs, or getting a raise or promotions, being with the same job, title, position and employer with no way out until it gets approved. Immigration Voice, a non-profit organization in the US, founded in Nov 2005 has begun grassroots level effort to alleviate the untold sufferings of high skilled professionals and has been working actively through volunteer members of the organization, that has grown to 9,000+ members in just more than a year. Immigration Voice recently hired Patton Boggs, a top public affairs firm for lobbying efforts towards the immigration goals of the high skilled worker community. Immigration Voice is now heavily engaged pursuing CIR or the Comprehensive Immigration Reform which will be introduced in the Senate in early March 2007 and then proceed to the House before it will be signed by the President to be enacted. This may very well be the ray of hope for the thousands of immigrants stranded on the not-so-green-now land of green cards.

I agree with both the ideas.
In fact the idea of the banner with 'Waiting for X years' is fantastic ..
That would be an amazing sight where everyone holds placards that say since when they have been waiting.
If it's even 400 people .. we have 400 people saying look we've been waiting since 5,7 or 9 years.
It's also important to get in heavyweights like either local folks like Google HR head or any public face. Google has always supported the Immigration issues .. since they have problems because they couldn't hire folks when the h1 lottery happenned.

If you are in March first week PD, you will be current from September 1st 2010.
I would do the following.
I will open a SR on the first working day of the September (As you have already done this and can not do one more SR in the next 45 days)
Will taken an infopass around 10th of September (Just waiting to see whether the date retrogress or not. If the date stays as it is for October 2010 i don't go to infopass otherwise i will go to infopass around mid of September to find out more details)

Hi,
I have my I-140 (approved in May 07) approved from my previous employer. I am not sure whether he has revoked it or not. I am now working as full time employee with another company. How can i find out if my I-140 was revoked or not? I am yet to file a New PERM, i already got a PERM denial after joining this new employer :( looks like i have to file one more... This looks like a infinte loop :(

You can subscribe to CRIS email for status updates. But sometimes you may not get the email. The letter may directly go to your ex employer's Attorney.
Even if you get a NOID, it may go to your ex employer's Attorney. We all know this employer attorney nexus - they are ready to screw you.

Infopass appt for Interim EAD was not helpful at all.
They suggested the same that I did earlier, ie to fax USCIS hotline about my situation along with letter from emp saying that I am at risk of losing job.
I have done that several times, still no luck.
My EAD expires on aug 30th (yah, just 2 more business days).
Did everything in my hands, now just prepared to lose my job.
Surprising thing is I saw 2 soft LUDs on aug 25th and and 26th but still no approval nor RFE, case status still pending.
I know they are looking at my case, but doing nothing.
My wife's EAD was approved a month ago.
I asked my lawyer (from a big firm) if I will have a case on USCIS in case if I lose my job. She said, USCIS is famous for this kind of processing for 1000's still the cases wont stand against them.
I wld appreciate any suggestions/thoughts?
Efiled @ NSC on may 19th.
FP on july 3rd, still no approval.
My current EAD expires Aug 30th.
1) Requested expedited processing via phone.
Received email saying to wait for next 30 days.
2) Called NSC, agent gave a fax number and asked me to provide Emp letter.
Faxed the Emp letter and also a covering letter.
3) 2 weeks passed, still no reply, called up NSC again, explained situation that I wld lose my job if i dont get EAD extension by this month end. She opened a Expedited request and told me to wait for 10 days.
4) As a back up, I also took infopass appoint for next monday (90 days will be over by then)
Believe me, its not easy going thru these phases.
I do not know how to reach my congressman/senator, Anyone here, pls let me know. I am from fremont, CA.

EADs include special security measures to prevent counterfeiting and forgery. Only certain centers have the machinery needed to produce these cards. Since EADs are used as REAL ID for travel and DL etc., USCIS decided to stop issuing Interim EADs at Field Offices.
So despite what USCIS memo says I am concerned that Interim EADs are unlikely to be issued (this point in the memo might be an oversight by the officer who issued it). AFAIK Field Offices can only make a request to expedite the case. I would like to know if anyone has got Interim EAD recently. If so let us know!

They should have some logic regarding PD's (INDIA).
